1. Acceptance of Terms
By accessing or using Nairobi Feast — including browsing restaurant listings, using AI features, creating an account, posting community content, or clicking “Sign Up” — you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
If you do not agree with any part of these Terms, you must not access or use the Service. These Terms apply to all users, including casual visitors, registered users, and restaurant partners listed on the platform.
2. Definitions
- “Nairobi Feast” / “Platform” — the website nairobifeast.com and associated services, applications, and tools.
- “Naifeast Digital” / “we” — the company that owns and operates Nairobi Feast.
- “User” / “you” — any person who accesses or uses the Platform, including visitors, registered accounts, and restaurant partners.
- “Restaurant Partner” — a restaurant, eatery, or hospitality business whose listing appears on Nairobi Feast.
- “Diner” — a user who browses, reviews, or makes a reservation through the Platform.
- “AI Features” — the Nairobi Feast AI Mode, conversational dining assistant, vibe picker, curate experience, and related AI-powered tools.
- “User Content” — text, photos, reviews, community posts, and other material submitted by users to the Platform.
- “DineBook” — a separate reservation management platform (dinebook.co) operated by Naifeast Digital that powers the reservation feature for partner restaurants.
3. Description of Service
Nairobi Feast is a restaurant discovery, exploration, and reservation platform serving the Nairobi dining community. The Service includes:
- Restaurant discovery — searchable, filterable listings of Nairobi restaurants, cafes, bars, and dining experiences.
- Browse & filter — exploration by location, cuisine, vibe, neighbourhood, and curated collections.
- AI dining assistant — AI Mode with conversational recommendations, the Vibe Picker, and curated experience matching.
- Reservations — for partner restaurants that run on DineBook, users can book a table directly through the Platform.
- Events — a curated calendar of food events, restaurant specials, and dining experiences in Nairobi.
- Community — a space for diners to share photos, experiences, and dining moments from Nairobi restaurants.
- Bill Share — a tool to split restaurant bills digitally among dining groups.
We provide the platform and technology; individual restaurants are responsible for their own operations, menus, hours, pricing, and guest experience.
4. Eligibility & Accounts
- Age: You must be at least 13 years old to use the Service. Features that involve alcohol-related venues require you to be of legal drinking age in Kenya (18+).
- Accurate information: When creating an account, you must provide accurate, current, and complete information. You are responsible for keeping this up to date.
- Account security: You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
- One account per person: Each natural person may maintain only one personal account. Creating multiple accounts to circumvent restrictions is prohibited.
- Account suspension: We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent activity, with or without prior notice.
5. User Conduct & Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable Kenyan or international law.
- Post false, misleading, defamatory, harassing, abusive, obscene, or discriminatory content.
- Make fake, spam, or malicious reservations with the intent to harm a restaurant partner.
- Scrape, crawl, index, or otherwise extract data from the Platform in an automated manner without our written consent.
- Reverse engineer, decompile, or attempt to access the source code of the Platform.
- Upload or transmit malware, viruses, or any code designed to disrupt or damage the Service.
- Impersonate any person, business, or entity, including Nairobi Feast staff or restaurant owners.
- Commercially exploit any content from the Platform without our explicit written permission.
- Use the Platform to send unsolicited marketing communications to other users or restaurants.
- Interfere with, disrupt, or overload the Platform infrastructure or any connected systems.
Violations may result in immediate suspension, permanent account termination, and where appropriate, legal action.
6. Restaurant Listings & Content
- Accuracy: While we strive to keep listing information (hours, menus, prices, contact details) accurate, restaurants may change their details without notice. Always verify directly with the restaurant before visiting.
- Editorial discretion: We reserve the right to edit, remove, or decline any restaurant listing at our sole discretion, including listings that contain inaccurate information, violate our policies, or harm the platform community.
- Sponsored content: Some listings or placements may be paid or promoted. These are disclosed where required.
- No endorsement: Listing on Nairobi Feast does not constitute our endorsement of, or warranty for, any restaurant, its food quality, hygiene, pricing, or service.
- Restaurant partners: Restaurants wishing to be listed or to manage their listing may contact us at [email protected]. Partners are responsible for the accuracy of information they provide.
7. Reservations & Third-Party Booking
Where available, reservations on Nairobi Feast are powered by DineBook (dinebook.co), a separate platform operated by Naifeast Digital. By making a reservation through Nairobi Feast, you also agree to DineBook's terms.
- Confirmation: A reservation is not confirmed until you receive an explicit confirmation from the restaurant or via the Platform.
- Cancellations: Cancellation policies are set by the individual restaurant. Please check the restaurant's policy before booking. Repeated no-shows may result in restricted booking access.
- Accuracy: You are responsible for providing accurate booking details (name, contact, party size, date, time). We are not liable for errors resulting from incorrect information.
- Availability: Real-time availability is controlled by the restaurant. We do not guarantee that a requested time or table will be available.
- Our role: Nairobi Feast acts as an intermediary connecting diners with restaurants. We are not a party to the reservation contract between you and the restaurant.
8. AI Features (Nairobi Feast AI)
Nairobi Feast offers AI-powered features including a conversational dining assistant, AI Mode, Vibe Picker, and curated experience matching. By using these features, you acknowledge:
- Third-party AI providers: Our AI features are powered by third-party AI services (including Anthropic Claude and others). Your use of these features is subject to those providers' terms as well as ours.
- Accuracy: AI-generated recommendations, suggestions, and responses may be inaccurate, incomplete, or outdated. They do not constitute professional advice. Always verify restaurant details independently.
- Data processing: Conversations with our AI assistant may be processed by our AI providers to generate responses. See our Privacy Policy for details on how this data is handled.
- No guarantee: AI features are provided “as is”. We do not warrant that they will meet your needs or be available without interruption.
- Feedback: AI responses are not endorsed by us as factual statements about any specific restaurant. If you encounter inaccurate information, please report it to [email protected].
10. Intellectual Property
The Nairobi Feast Platform, including its design, branding, software, code, logo, text, graphics, and curated content (excluding User Content and restaurant-provided materials), is the exclusive property of Naifeast Digital and its licensors, protected by Kenyan and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you.
11. Third-Party Services & Links
The Platform integrates with and links to third-party services, including:
- DineBook (reservation management) — dinebook.co
- Supabase (database and media storage)
- Anthropic / Claude (AI assistant)
- Uber (transport integration on restaurant pages)
- Google Maps (mapping and location services)
Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of any third-party service, and their inclusion does not constitute our endorsement of them.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, Naifeast Digital disclaims all warranties — express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure at all times.
- Restaurant information (hours, prices, menus, availability) is accurate or current.
- AI-generated content is accurate, complete, or reliable.
- Any particular restaurant will meet your expectations or dietary requirements.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Naifeast Digital, its directors, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or related to these Terms or the Service will not exceed KES 10,000 or the amount you paid to us (if any) in the 12 months preceding the claim, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Naifeast Digital and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of:
- Your use of or access to the Service.
- Your User Content and the rights you grant or claim over it.
- Your breach of these Terms or any applicable law or regulation.
- Your violation of any third-party rights, including intellectual property or privacy rights.
15. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, the dispute may be referred to arbitration in Nairobi, Kenya, under the Arbitration Act (Cap. 49) and the rules of the Nairobi Centre for International Arbitration, conducted by a single arbitrator in English. Nothing prevents either party from seeking urgent interim relief from the courts of Kenya sitting at Nairobi.
16. Changes to Terms & Service
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify registered users by email or in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
We may also modify, suspend, or discontinue any feature of the Service at any time, with or without notice, and we will not be liable to you for any such change.
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- Waiver: Our failure to enforce any provision is not a waiver of that right.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including infrastructure outages, natural disasters, or acts of government.
